Terms of Service

1. Acceptance of terms

These Terms of Service (“Terms”) govern your access to and use of getcapz (“getcapz”, “we”, “us”), including our website, dashboard, and caption generation tools (together, the “Service”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. What getcapz does

getcapz lets you upload video files and generates synced captions, including support for Darija in Latin script, Arabic script, and mixed French or English speech. You can edit captions in our timeline editor and export a captioned video or a subtitle file.

3. Your account

You're responsible for keeping your login credentials secure and for all activity under your account. Let us know right away if you suspect unauthorized access. You must be at least 13 years old to use the Service, or the age of digital consent in your country if that's higher.

4. Your content

You retain ownership of the videos you upload and the captioned exports getcapz generates from them (“Your Content”). You're solely responsible for Your Content and for having the rights to upload it and to use it the way you do — including any voices, faces, music, or third-party material it contains.

You grant getcapz a worldwide, non-exclusive, royalty-free license to host, store, process, and transmit Your Content solely as needed to operate and provide the Service to you (for example: transcription, rendering, storage, and delivery).

5. Showcasing your content for marketing

By using the Service, you also grant getcapz a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute Your Content — specifically the captioned video exports produced by the Service — for marketing and promotional purposes. This includes featuring clips on our website, in a landing page showcase or carousel, on our social media accounts, and in advertising.

We won't sell Your Content to third parties or use it in a way that's unrelated to promoting getcapz. If you'd rather your content not be featured this way, email us at support@getcapz.com with the account email or clip in question and we'll take it down from any promotional use going forward.

6. Acceptable use

You agree not to use getcapz to:

• Upload content you don't have the rights to, or that infringes someone else's intellectual property
• Upload unlawful, defamatory, harassing, or sexually explicit content involving minors
• Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or other users' accounts
• Use the Service to generate spam or misleading content

We may suspend or terminate accounts that violate this section.

7. Plans, limits, and billing

getcapz offers a free tier with monthly usage limits, and paid plans with expanded limits and features. Paid plans are billed in advance on a recurring basis through our payment processor. You can cancel anytime from your dashboard; access continues until the end of the billing period you've already paid for. Fees are non-refundable except where required by law.

8. Intellectual property

Aside from Your Content, the Service — including its software, design, and branding — is owned by getcapz and protected by intellectual property law. These Terms don't grant you any rights to our trademarks or branding.

9. Disclaimers

The Service is provided “as is” without warranties of any kind, express or implied. We don't guarantee that transcription or captions will be error-free, or that the Service will be uninterrupted or available at all times.

10. Limitation of liability

To the maximum extent permitted by law, getcapz won't be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.

11. Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms. Sections that by their nature should survive termination — including ownership, the license grants in Sections 4 and 5, disclaimers, and limitation of liability — will survive.

12. Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll update the date at the top of this page and, where appropriate, notify you directly. Continuing to use the Service after changes take effect means you accept the updated Terms.
